Wide publicity has been given the decision of the
Supreme Court of California that the law against inter
racial marriage is unconstitutional.
The majority opinion stated that marriage is something
more than a civil contract subject to regulation by the state,
and it is a fundamental right of free men. It cannot be pro
hibited, except for important social objectives and then only
on the merits of individual cases.

It’s the principle we’re concerned about and not so much
the social and other implications. And we would say “Nuts”
to the court’s minority opinion with more feeling than with
considered thought.
It is refreshing nevertheless to dwell upon the more
thoughtful and learned views of the Christian Science Moni
tor :
Most geneticists will question the latter point (that
intermarriage leads to retrogression). They lack positive
evidence that racial crosses are either good or bad, .

But sociologists in general agree that marriages across
any great chasm created by the mores of the time and
place run grave social risks, whether that chasm be be

victions. Such marriages face formidable obstacles to
success. They can impose strains, confusions, and con
flicts upon the children. Nowhere are these problems
•more acute (in the United States) than where marriages
cross the color line. The community often feels the impact
as well as the individuals directly involved.
Is this California decision, then, the entering wedge
for dire social consequences? Probably not. It is doubtful if many American laws rest upon more deeply rooted
mores than do the statutes against interracial marriages.
Such unions are rare in the 19 states which do not bar
them legally. Much more than a law inhibits them in the
29 stales which still do.
Standing as it docs within the framework of contemporary social forces, the California decision looks
more like a somewhat abstract victory for individual
freedom—a freedom likely to be claimed for this purpose
only by an exceptional few—than as a prelude to any
substantial change in the American scene within the
foreseeable future.
